Terms of Service
Welcome to Manaska. These Terms of Service ("Terms") govern your access to and use of the Manaska mobile application, website and related educational services (collectively, the "Services").
Manaska is operated by Hritik Kumar, a sole proprietor based in India ("Manaska", "we", "us" or "our").
By creating an account, accessing or using the Services, you agree to these Terms, subject to any additional consent or authorization required by applicable law. If you are using Manaska on behalf of a child or an educational institution, you must have the authority required for that use. Please read these Terms together with our Privacy Policy.
1. About Manaska
Manaska is an educational technology platform designed to support learning through lessons, readings, practice activities, assessments, feedback, progress tracking and an AI tutor.
Features may vary depending on your account, course, access permissions and the current stage of product development. We may introduce, modify, improve, replace or discontinue features as the platform evolves.
2. Test-version services
Manaska may initially be made available to a limited group of invited users, and access may require an invitation code. During testing, features and educational content may be incomplete, contain errors or change as we improve the platform. We may collect feedback and diagnostic information to identify and resolve issues, as described in our Privacy Policy.
3. Eligibility and accounts
You must provide accurate information reasonably necessary to create and maintain an account.
If you are under 18, a parent or guardian must agree before you create an account. At sign-up you confirm this through a checkbox. We do not currently verify this confirmation independently. Parents and guardians who allow a child to use Manaska are responsible for supporting the child in using the Services appropriately.
You are responsible for maintaining the confidentiality of your account credentials and for activities conducted through your account, except where responsibility rests with Manaska or another party under applicable law. You must not intentionally impersonate another person, access an account without permission or misuse another user's credentials.
Please notify us if you believe your account has been compromised. We may use reasonable account verification and security measures to protect users and the Services.
4. Educational content and features
Manaska provides educational content and activities for learning and practice. While we aim to provide accurate and useful information, educational material may contain errors, omissions or differences in interpretation.
Learning recommendations, assessment results and progress indicators are intended to support learning. They should not be treated as guaranteed measures of a student's abilities or future performance.
Unless explicitly stated otherwise, Manaska does not award government-recognized qualifications, guarantee examination results or replace accredited educational institutions. Students, parents and teachers should use appropriate judgment when relying on educational feedback and recommendations.
5. Artificial intelligence
Ask tutor is currently Manaska's student-facing AI feature. It uses artificial intelligence to generate educational explanations and responses. We may introduce additional AI-powered features in the future.
AI-generated content may be incomplete or inaccurate and should be reviewed appropriately. Please check important information with a teacher or qualified person. Ask tutor is intended for educational assistance and is not a substitute for emergency, medical, legal, financial or other professional services.
We may change AI models, providers and technical implementations to improve the Services.
6. Acceptable use
You agree to use Manaska lawfully and in a manner that does not harm other users or disrupt the Services. You must not:
- Attempt unauthorized access to accounts, systems or information.
- Use the Services to threaten, harass, exploit or abuse others.
- Upload or distribute unlawful, malicious or otherwise prohibited material.
- Deliberately interfere with the security, availability or operation of the Services.
- Misrepresent your identity or authority to access information belonging to others.
- Use automated means to extract substantial amounts of protected content or access the Services beyond authorized technical limits without permission.
Reasonable educational use, personal study, note-taking and sharing of learning outcomes are permitted, subject to applicable rights. We may take proportionate action against misuse, including warnings, feature limitations, suspension or account termination.
7. User content
You may submit questions, answers, notes, doubts, feedback, messages and other content through the Services. You retain any ownership rights you have in content you submit to Manaska.
You grant Manaska a non-exclusive, worldwide, royalty-free licence to store, reproduce, process, analyze and display that content as reasonably necessary to provide, operate, secure, maintain and improve the Services, as described in our Privacy Policy and subject to applicable law. This licence does not override applicable privacy rights or authorize unrestricted use of identifiable personal information.
You are responsible for ensuring that content you submit does not unlawfully infringe another person's rights. We may remove or restrict access to content where reasonably necessary to comply with law, protect users or enforce these Terms.
8. Research and service improvement
Manaska may use educational interactions, feedback and performance information to operate, personalize, evaluate and improve the Services.
For educational research and the development, evaluation or training of internal artificial intelligence and machine learning models, including generative AI, we may use aggregated or genuinely anonymized educational information, as described in our Privacy Policy.
We may retain and use genuinely anonymized educational datasets, aggregate findings, research results and model artifacts that do not identify individuals for future research and internal model and product development.
Any other processing of identifiable personal information remains subject to applicable law and any required consent. Nothing in these Terms transfers ownership of a user's personal information to Manaska.
9. Teachers and educational institutions
If Manaska offers classes or teacher features, access to student information depends on the relevant role, class membership and permissions. Teachers and institutions must use information made available to them for legitimate educational purposes and comply with applicable law, and must not seek unauthorized access to private student conversations or other restricted information. Separate arrangements may apply where an institution purchases or administers Services on behalf of its students.
10. Intellectual property
Manaska and its licensors retain their respective rights in the Services, including original software, interfaces, designs, branding, educational materials, question banks, AI systems and other protected content.
You receive a limited, non-exclusive, non-transferable and revocable permission to access and use the Services for their intended purposes, subject to these Terms. You may use educational content for personal learning and other uses permitted by law or expressly authorized by Manaska. You must not commercially redistribute or exploit substantial protected portions of Manaska's original content or software without appropriate permission, except where applicable law permits. Third-party educational materials remain subject to their respective licences and rights.
11. Fees and paid services
Manaska's current features are free. Paid plans or purchases may become available later. Where fees apply, relevant pricing, billing terms and plan details will be presented before purchase.
Payments, renewals, cancellations and refunds may be governed by the applicable app store or payment provider, together with any mandatory consumer protections. We will not charge users for a paid plan without presenting the applicable payment terms and obtaining the required authorization. We may change pricing or plans prospectively, subject to applicable law and any existing purchase commitments.
12. Service availability and changes
We aim to keep Manaska accessible and reliable but do not guarantee uninterrupted or error-free availability. The Services may be temporarily unavailable due to maintenance, technical failures, security incidents, third-party dependencies or circumstances beyond our reasonable control. We may update, reorganize or discontinue features for technical, educational, operational or business reasons.
13. Account suspension and termination
You may stop using Manaska at any time and delete your account.
We may suspend or terminate access where reasonably necessary because of serious misuse, security risks, legal requirements, violations of these Terms or discontinuation of the Services. Where appropriate and reasonably practicable, we may provide notice or an opportunity to resolve the issue.
Termination does not eliminate rights or obligations that legally survive termination, including intellectual property rights, lawful record retention and dispute-related provisions. Handling of personal information following termination is governed by our Privacy Policy and applicable law.
14. Disclaimers and limitation of liability
The Services are provided "as is" and "as available". To the extent permitted by applicable law, we do not guarantee specific examination scores, academic outcomes, uninterrupted service or the complete accuracy of all educational or AI-generated information. Manaska is not responsible for losses caused solely by circumstances outside its reasonable control.
To the extent permitted by law, Manaska will not be liable for indirect or consequential losses arising from the use of the Services, and our total liability for any claim is limited to the greater of the amount you paid us for the Services in the previous 12 months or ₹1,000.
Nothing in these Terms excludes or limits any liability, remedy, consumer right or other statutory right that cannot lawfully be excluded or limited.
15. Privacy and data protection
Our collection and use of personal information are described in our Privacy Policy. Where required by law, we will obtain separate consent or authorization for relevant processing activities. You may delete your account and exercise applicable privacy rights as described in our Privacy Policy and on the Delete your account page.
16. Governing law and disputes
These Terms are governed by the laws of India. If you have a concern about the Services, please contact us so that we can attempt to resolve it. Disputes will be subject to the jurisdiction of courts or other competent forums in India as determined by applicable law. Nothing in these Terms limits any mandatory consumer right or right to approach an authority or forum having jurisdiction under applicable law.
17. Changes to these Terms
We may revise these Terms to reflect changes to our Services, business practices or applicable requirements. Updated Terms will be published with a revised "Last updated" date. Where required, we will notify users of material changes and obtain appropriate acceptance or consent before the changes take effect.
